1. Acceptance of Terms

By downloading, installing, or using the Mystigo mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. Your use of the App is also governed by our Privacy Policy, which explains how we collect and process your personal data.

2. Description of Service

Mystigo is a gamified urban exploration application that allows users to discover points of interest, solve enigmas, participate in itineraries, and compete on a global leaderboard. The service includes:

• Curated urban itineraries with geolocated points of interest
• Enigma challenges of various types (multiple choice, QR codes, AI camera scans, etc.)
• A global leaderboard and ranking system
• Passive heritage site discovery via background location
• User-generated content submission for new points of interest

3. User Accounts

Some features of the App require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent points of interest or answers
• Attempt to manipulate the leaderboard or scoring system
• Interfere with or disrupt the integrity or performance of the App
• Harass, abuse, or harm other users
• Use automated tools, bots, or scripts to interact with the App

5. Location Data

The App requires access to your device's location to function. With your permission, the App may use background location to detect nearby heritage sites even when the App is not actively in use. You can revoke location permissions at any time through your device settings, though this will limit App functionality. 6. User-Generated Content

When you submit photos or information about points of interest, you grant Mystigo a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content within the App and related services. You represent that you have the right to submit such content and that it does not infringe any third-party rights.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Mystigo and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Mystigo does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Mystigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Mystigo is not responsible for any injuries, accidents, or damages that may occur while physically participating in itineraries or visiting points of interest.

10. Safety Notice

When using the App, always prioritize your safety. Be aware of your surroundings, obey all traffic laws, and do not trespass on private property. Mystigo is not responsible for any harm that results from participating in itineraries or visiting points of interest.

11. Modifications to Terms

Mystigo reserves the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

Mystigo may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App settings.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
